U.S. regulators drop fraud case against Wall Street financier Wey 


(Reuters) - U.S. securities regulators on Friday moved to drop their fraud case against Wall Street financier Benjamin Wey, about a month after prosecutors dropped a related criminal case after a judge threw out some evidence

In a filing in federal court in Manhattan, the U.S. Securities and Exchange Commission said its case relied on the same evidence as the criminal case, and that it believed it would no longer be able to use it.

Prosecutors and the SEC in 2015 accused Wey, the founder of New York Global Group, of making tens of millions of dollars by secretly controlling large blocks of shares through “reverse mergers” between Chinese companies and U.S. shell companies, and selling his shares at artificially high levels.

The SEC also sued Wey’s wife, Michaela Wey, who was not criminally charged.

“Today’s dismissal can only be described as a complete victory for our clients, Benjamin and Michaela Wey,” said David Siegal, a lawyer for the Weys.

SEC spokesman Ryan White declined to comment.

The criminal case against Wey collapsed in June, when U.S. District Judge Alison Nathan ruled that a huge cache of materials seized from Wey’s home and offices could not be used because they were obtained with overly broad search warrants that violated Wey’s constitutional rights.

Nathan said the seizure of items such as children’s school records, family photos and X-rays at minimum reflected “grossly negligent or reckless disregard” of the Fourth Amendment, which protects against unreasonable search and seizure.

John Conyers, Jr., (D-Mic) is stepping down as the ranking member of the House Judiciary Committee pending an investigation into allegations of sexual harassment.

“After careful consideration and in light of the attention drawn by recent allegations made against me, I have notified the Democratic Leader of my request to step aside as Ranking Member of the House Judiciary Committee during the investigation of these matters," he said in a statement.

“I deny these allegations, many of which were raised by documents reportedly paid for by a partisan alt-right blogger. I very much look forward to vindicating myself and my family before the House Committee on Ethics," he added.

House Members Introduce Bipartisan Legislation to Expand Whistleblower Protections for Federal Contractors

Washington, DC—Today, Reps. John Conyers, Jr., Ranking Member of the House Committee on Judiciary, Elijah E. Cummings, Ranking Member of the House Committee on Oversight and Government Reform, Jason Chaffetz, Chairman of the Oversight Committee Stephen F. Lynch, and Hakeem Jeffries, introduced H. R. 5920, the Whistleblower Protections for Contractors Act, to expand whistleblower protections to additional federal contractors and grantees.

“Whistleblowers are the front line of defense against waste, fraud, and abuse," the Members said. "The employees who work on federal contracts and grants see firsthand when taxpayer money is being wasted, and they must be protected against retaliation when they blow the whistle on wrongdoing.  This bill makes such protections permanent and ensures more employees are covered.”

H.R. 5920 is a companion bill to S. 795, introduced by Senator Claire McCaskill (D-Mo) and cosponsored by Senator Ron Johnson (R-WI), and gives subgrantees and personal services contractors the same whistleblower protections currently given to contractors, grant recipients, and subcontractors. This bill also makes existing protections permanent for civilian contractors and grantees
